Music, Copyright, Limitation of Liability & Indemnity
Where a Client requests that JP Sports Media incorporate copyrighted or commercially released music into a video, the Client acknowledges that the request is made at their own discretion.
The Client is solely responsible for ensuring they have all necessary rights, licences and permissions to use, upload, publish, distribute or otherwise communicate that music on any social media platform, website or other public or private medium.
JP Sports Media does not own or licence third-party music and does not warrant or guarantee that any platform will permit the use of such music. Videos containing copyrighted music may be muted, blocked, removed, demonetised or otherwise restricted by copyright owners or platform policies.
To the maximum extent permitted by law, JP Sports Media accepts no liability for any copyright infringement claims, takedown notices, account restrictions, loss of content, loss of revenue, demonetisation, platform penalties or any other loss or damage arising from the Client’s request for, or subsequent use, upload or publication of, a video containing copyrighted music.
The Client agrees to indemnify and hold harmless JP Sports Media, its owners, employees and contractors from and against any claims, demands, liabilities, damages, costs (including reasonable legal costs), expenses or losses arising from or relating to the Client’s request for copyrighted music or the Client’s upload, publication, distribution or other use of the completed video.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or any other applicable legislation.
